Terms of Service

These Terms of Service (the “Terms”) form a legally binding agreement between you and LootBeezShop, a [Sole Proprietorship / LLP / Private Limited Company] having its registered office at [REGISTERED ADDRESS, CITY, STATE, PIN] (“LootBeez”, “we”, “us” or “our”). They govern your access to and use of the website at lootbeez.shop, the LootBeez web application, the LootBeez mobile applications and all related services (together, the “Platform”).

Please read these Terms carefully. By creating an account, clicking “I agree”, or using the Platform in any way, you confirm that you have read, understood and agree to be bound by these Terms, our Privacy Policy, the Contributor Agreement & Consent, the Payment & Payout Policy and the Community & Quality Guidelines, each of which is incorporated into these Terms by reference. If you do not agree, you must not use the Platform.

This document is an electronic record under the Information Technology Act, 2000 and the rules made under it, and does not require a physical or digital signature.

Definitions

• “Contributor” means an individual who registers on the Platform to perform Tasks.
• “Task” means any activity offered on the Platform, including reading a sentence aloud, speaking a command, describing an image, speaking on a topic, or transcribing audio.
• “Contribution” means any audio recording, transcription, text or other material you submit through the Platform.
• “Project” means a collection of Tasks created for a specific purpose, language or customer, with its own rate, limits and instructions.
• “Approved Contribution” means a Contribution that has passed our automatic checks and human review.
• “Reviewer” means a user to whom we have granted permission to review Contributions.
• “Coordinator” means a user to whom we have granted the coordinator role to recruit and support Contributors in a locality.
• “Business Customer” means a company, institution or individual that purchases or licenses data from LootBeez under our Data Licence Terms.
• “Balance” means the amount earned by you for Approved Contributions and bonuses that has not yet been paid out.

Eligibility

• You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872. We do not knowingly permit minors to use the Platform.
• You must be a natural person. Accounts may not be opened by companies, groups or on behalf of another person.
• You may hold only one account. Creating or operating multiple accounts, including through family members, is prohibited.
• You must have a valid UPI ID in your own name to receive payments.
• You must not have been previously suspended or removed from the Platform.
• You must provide true, accurate and complete information during registration and keep it up to date, including your age, gender, state, district, dialects and UPI ID. Speaker information is an essential part of the data we deliver, and providing false information is a material breach of these Terms.

Your account and security

• You log in using a one-time code sent to your email address. You are responsible for keeping access to your email account secure and for all activity carried out through your LootBeez account.
• Never share your login code with anyone. LootBeez staff will never ask you for a login code, password, OTP, bank PIN or card details.
• Notify us immediately at support@lootbeez.shop if you suspect unauthorised access to your account.
• We may refuse registration, or require additional verification (for example, PAN for tax purposes), at our discretion and in accordance with law.

Nature of the relationship

You use the Platform as an independent contributor. Nothing in these Terms creates any employment, agency, partnership or joint-venture relationship between you and LootBeez or any Business Customer. You are free to decide whether, when and how much to work, subject to project limits. You are not entitled to wages, salary, provident fund, gratuity, leave or any other employment benefit. You are responsible for your own equipment, internet connection and expenses.

No guaranteed work or income. Tasks are available only when a Project is active for a dialect you speak. Projects may be paused, changed or closed at any time without notice, for example when a customer’s target is reached. We do not promise any minimum amount of work, earnings or payments.

Tasks and projects

• Each Project displays its task type, the rate payable per hour of approved audio, the minimum and maximum clip duration, and the maximum amount of audio you may contribute to that Project. You should review this information before starting.
• You must follow the instructions shown for each Project and our Community & Quality Guidelines.
• Only perform Tasks in dialects you speak fluently and naturally.
• We may set daily limits, per-Project limits and other controls to protect data quality, speaker diversity and the Platform.

Training and quality levels

• Before your first Task you must pass a short training test. You may retake it as often as needed.
• After a minimum number of your Contributions have been reviewed (currently 20), your approval rate over your most recent reviewed Contributions (currently up to 200) determines your quality level: Bronze, Silver or Gold. Silver and Gold levels receive a percentage bonus on Approved Contributions, as shown in the app at the time of approval.
• Quality-level thresholds and bonus percentages may be changed for future work. Changes do not affect amounts already credited to your Balance.
• Your level is calculated automatically from review outcomes. If you believe a review outcome is wrong, you may raise it as described in the Payment & Payout Policy.

Submission and review

• Every Contribution is checked automatically (for example, for silence, loudness, clipping, duration and duplication) and reviewed by a human Reviewer. Contributions that fail automatic checks may be refused at upload.
• Reviewers decide whether a Contribution meets the Project instructions and our guidelines. Rejected Contributions are not paid. The reason for rejection is shown in the app.
• We aim to review Contributions within seven (7) days of submission, but review times depend on volume and are not guaranteed.
• We may re-review any Contribution, including an Approved Contribution, where we have reason to suspect error or fraud, and may adjust earnings as set out in the Payment & Payout Policy.

Earnings, bonuses and payouts

Your earnings, quality-level bonuses, referral bonuses, coordinator commissions, payout schedule, minimum payout, tax deductions and dispute process are governed by our Payment & Payout Policy. In summary: you earn the Project rate multiplied by the duration of approved audio (plus any applicable bonus), credited to your Balance on approval and paid weekly by UPI once your Balance reaches the minimum payout.

Taxes

You are solely responsible for declaring and paying any taxes due on your earnings. Where required by the Income-tax Act, 1961 or other applicable law, we may deduct tax at source (TDS), report payments to tax authorities and require your Permanent Account Number (PAN) before making further payments. Amounts deducted as tax will be shown in your statement and deposited with the government in accordance with law.

Rights in your Contributions

To allow LootBeez to license data to Business Customers, you agree that, upon submission of each Contribution and to the maximum extent permitted by law:

1. You assign to LootBeez, absolutely and irrevocably, all right, title and interest, including all copyright and related rights, in the Contribution, for the full term of such rights and throughout the world, in accordance with Section 18 and Section 19 of the Copyright Act, 1957. The assignment is for all modes and media of exploitation, whether now known or developed in future.
2. To the extent any rights cannot be assigned, you grant LootBeez and its Business Customers a worldwide, perpetual, irrevocable, royalty-free, transferable and sub-licensable licence to use, reproduce, modify, adapt, analyse, translate, distribute, sell, license and create derivative works from the Contribution.
3. You consent to the use of your voice and speech characteristics contained in the Contribution for the purposes of training, testing, evaluating and improving speech, language and artificial-intelligence technologies, and for related research, as further described in the Contributor Agreement & Consent.
4. You agree not to assert any moral rights in a manner that would prevent the uses described above, to the extent permitted by law.

The consideration for this assignment is the payment for Approved Contributions under the Payment & Payout Policy. No payment is due for Contributions that are rejected. Rejected Contributions are not delivered to Business Customers.

You represent and warrant that each Contribution is your own original work in your own natural voice; that it does not contain the voice of any other person, synthetic or AI-generated audio, or playback of a recording; that it does not contain personal information about any person unless the Task specifically requires it; and that it does not infringe any third-party right or violate any law.

Platform intellectual property

The Platform, including its software, design, text, prompts, images, logos and the “LootBeez” name, is owned by or licensed to LootBeez and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to use the Platform for its intended purpose. You must not copy, modify, distribute, sell or reverse-engineer any part of the Platform, or use prompts and Project materials for any purpose other than completing Tasks.

Prohibited conduct

You must not, and must not attempt to:

• submit another person’s voice, a recording of a recording, text-to-speech or other synthetic audio, or audio previously submitted by you or anyone else;
• create or use more than one account, use another person’s account, or allow another person to use yours;
• refer yourself, create fake referrals, or offer payment or inducements for referrals;
• provide false profile information, including age, gender, location or dialect;
• record minors or any person without their consent, or include personal information about yourself or others in Contributions unless requested by the Task;
• submit abusive, obscene, hateful, defamatory, sexually explicit or unlawful content;
• manipulate, bypass or interfere with quality checks, limits, review processes or security measures;
• use bots, scripts, emulators or automated tools to access the Platform or perform Tasks;
• scrape, copy or extract data, prompts or audio from the Platform;
• charge anyone money to join LootBeez, sell accounts, or misrepresent yourself as an employee or agent of LootBeez;
• harass, threaten or abuse Reviewers, staff or other users; or
• use the Platform in violation of any applicable law.

Fraud prevention and enforcement

We use automated and manual measures to detect fraud, including duplicate-audio detection, shared payment-identifier detection and quality monitoring. If we reasonably believe you have breached these Terms or our guidelines, we may, in proportion to the breach and in accordance with law:

• reject affected Contributions;
• issue a warning or temporarily restrict your access to some or all Projects;
• withhold, reverse or set off earnings that arose from the breach, including after payment, against your current or future Balance;
• suspend or permanently close your account; and
• report unlawful activity to the appropriate authorities.

Where practicable we will tell you the reason for the action and give you an opportunity to respond through the grievance process. Earnings from genuine Approved Contributions that are unaffected by the breach will not be forfeited.

Reviewers and coordinators

We may invite Contributors to act as Reviewers or Coordinators. If you accept such a role, in addition to these Terms you agree that:

• as a Reviewer, you will review honestly, consistently and only in languages you understand well; you will never review your own Contributions or those of people you know personally; and you will apply the published guidelines without bias;
• you will keep all audio, transcripts and user information you access strictly confidential, will not download, record, copy or share it outside the Platform, and will use it only to perform your role;
• as a Coordinator, you will not charge anyone any fee, will not promise income on our behalf, will explain the consent clearly and truthfully, and will not pressure anyone to participate; and
• we may remove a role at any time. Any commission or reviewer payment will be as set out in the Payment & Payout Policy or notified in the app.

Business Customers

If you purchase or license data from LootBeez, our Data Licence Terms and any signed order or agreement apply in addition to these Terms. In case of conflict, the signed order prevails, followed by the Data Licence Terms.

Privacy

We process personal data in accordance with our Privacy Policy and the Digital Personal Data Protection Act, 2023. By using the Platform you acknowledge the processing described in that policy.

Communications

You agree to receive service communications from us by email and in-app notification, including login codes, payment confirmations, replies to your questions and important changes to these Terms. These are part of the service and are not marketing messages.

Third-party services

The Platform relies on third-party providers for hosting, storage, email delivery and payments (for example Cloudflare and UPI payment providers). Your use of UPI is also subject to the terms of your bank and UPI app. We are not responsible for the acts or omissions of banks or payment networks, but we will help you trace any payment we have made.

Availability and changes to the Platform

We aim to keep the Platform available at all times but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue any feature, Project or the Platform, temporarily or permanently. If we discontinue the Platform, we will pay all approved Balances in accordance with the Payment & Payout Policy.

Disclaimers

To the maximum extent permitted by law, the Platform is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Earnings examples on our website are illustrative only. See our Disclaimer.

Limitation of liability

To the maximum extent permitted by law: (a) LootBeez will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or opportunity; and (b) LootBeez’s total aggregate liability to a Contributor for all claims arising out of or relating to the Platform will not exceed the total amount earned by that Contributor for Approved Contributions in the three (3) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, or your right to receive payment for Approved Contributions.

Indemnity

You agree to indemnify and hold harmless LootBeez, its owners, officers, employees and Business Customers from any claim, loss, liability or expense (including reasonable legal fees) arising from your breach of these Terms, your Contributions (including any breach of the warranties in the section on Rights in your Contributions), or your violation of any law or third-party right.

Suspension and termination

• You may stop using the Platform at any time and may request closure of your account from Profile → “Delete my account & data”.
• We may suspend or terminate your account as described in the section on Fraud prevention and enforcement, or if we are required to do so by law, or if your account has been inactive for more than twenty-four (24) months.
• On closure, any approved Balance at or above the minimum payout will be paid to your registered UPI ID, subject to the Payment & Payout Policy and any lawful set-off. Balances below the minimum payout will be paid on request.
• Sections relating to Rights in your Contributions, Taxes, Limitation of liability, Indemnity, Governing law and any other provisions that by their nature should survive will survive termination.

Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page with a new effective date and, for material changes, notify you in the app or by email at least seven (7) days before they take effect, unless the change is required sooner by law. Where a change affects your consent, we will ask you to accept the new version before you continue working. Changes do not apply retroactively to Contributions already approved.

Governing law and dispute resolution

1. These Terms are governed by the laws of India.
2. Before starting any legal proceeding, you agree to first raise the issue with our Grievance Officer (see Grievance Redressal) and allow thirty (30) days for resolution.
3. Any dispute that is not resolved amicably shall be referred to arbitration by a sole arbitrator appointed by mutual agreement, under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be [CITY], [STATE], and the proceedings shall be conducted in English or Hindi.
4. Subject to the above, the courts at [CITY], [STATE] shall have exclusive jurisdiction. Nothing in this section prevents you from approaching a consumer forum or the Data Protection Board of India where you are entitled to do so by law.

General

• Entire agreement. These Terms, together with the documents incorporated by reference, are the entire agreement between you and LootBeez regarding the Platform.
• Severability. If any provision is held invalid, the remaining provisions remain in full force.
• No waiver. Our failure to enforce any right is not a waiver of that right.
• Assignment. You may not transfer your rights or obligations under these Terms. We may assign them to an affiliate or a successor to our business, with notice to you.
• Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, epidemics, network or power failures, banking-system outages and government action.
• Language. These Terms are written in English. Summaries or translations in Hindi or other languages are provided for convenience; if there is any inconsistency, the English version prevails, except where the law requires otherwise.
